Whilst the Immigration rules can be very difficult to navigate, there are still ways to utilise the wealth of culture, knowledge and experience of International students whose motivation and commitment to their careers, demonstrated by their commitment to studying in the UK at no small cost, is self evident.

One myth worth busting is that if you are hiring international students and want to retain them under a Tier 2 licence, you do NOT need to demonstrate the Resident Labour Market Test, by advertising the job for 28 days in specified media, or showing why they are the best person for the job over and above any British or European students that apply. This only kicks in if they are applying to return to the UK after their studies.

It’s never too late to apply to join the Tier 2 sponsor register, and if you already have an International student working for you who you think would be perfect for a permanent full time position, then it’s definitely worth signing up. You just need to confirm that there is a genuine vacancy, that the job is at graduate level and that you are willing and able to pay the relevant minimum salary set out in the Codes of Practice.

Just be mindful of the fact that these are updated from time to time, and that they are currently being reviewed again under the new Government.
